Claims Status Update (as of March 8, 2024):

THE CLAIMS FILING DEADLINE EXPIRED ON MAY 31, 2021 – no Proofs of Claim (“POC”) received after that date will be processed by the Receiver pursuant to orders of the Receivership Court.

The Receiver is evaluating the claims against the estate and is mailing written Notices of Claim Determination to claimants — and these notices  advise claimants of whether their claims are approved (in full or in part) or denied.  Approximately one thousand two hundred sixteen (1,216) Notices of Claim Determination have been completed and mailed to the claimants as of the Receiver’s Twenty-First Status Report to the Court (available under the “Receivership Documents” section of this web site). Approximately seventy-nine (79) objections to the Receiver’s claim determinations have been received to date, which the Receiver is also working to resolve (i.e., through the appeal hearing procedures that have been established by the Receivership Court and which are currently underway).  Additional information about the claims and appeals process can be found within the above- referenced status report, and within the subsequent quarterly reports to the Receivership Court. No claim distribution payments have been made to date, and none will be made until the Receivership Court approves a plan of distribution for Spirit’s assets. It is expected that Spirit will have sufficient assets to make a partial payment of its Class B priority claims. The SDR is working to complete the remaining Notices of Claim Determination, and thereafter hopes to be in a position to recommend an initial claims distribution to the Court for approval.

THERE IS NO SET TIMELINE FOR WHEN CLAIM DETERMINATIONS WILL BE COMPLETED AND DISTRIBUTIONS MADE, AND AS NOTED ABOVE ANY DISTRIBUTIONS WILL ULTIMATELY REQUIRE RECEIVERSHIP COURT APPROVAL. THE SDR IS NOT ABLE TO PROVIDE DETAILED STATUS UPDATES ABOUT INDIVIDUAL CLAIMS BY TELEPHONE BUT WILL ISSUE ANY COMMUNICATIONS ABOUT PROOFS OF CLAIM IN WRITING – THEREFORE, IT IS VERY IMPORTANT FOR CLAIMANTS TO KEEP THE SDR APPRISED OF ANY ADDRESS CHANGES. This notice provides important information regarding the liquidation of Spirit Commercial Auto Risk Retention Group, Inc. (“Spirit”).  On February 27, 2019, Spirit was placed in receivership by order (the “Permanent Receivership Order”) of the Eighth Judicial District Court of the State of Nevada (the “Receivership Court”).  Barbara D. Richardson, the Nevada Commissioner of Insurance, is the Receiver of Spirit and Cantilo & Bennett, L.L.P., is the appointed Special Deputy Receiver (“SDR”) of Spirit. On November 6, 2019, the Receivership Court entered its Final Order Placing Spirit into Liquidation (the “Liquidation Order”) and its Final Order Setting Claims Filing Deadline for Spirit and Related Relief (“the Claims Order”).  The orders are available on the “Receivership Documents” page of this web site and should be read in their entirety rather than just reading this notice.

The Claims Order approved a proof of claim (“POC”) process for filing claims against Spirit and established a Claims Filing Deadline for the submission of such claims. The Claims Filing Deadline has now been extended by order of the Receivership Court to May 31, 2021. The Order Extending Claims Filing Deadline is available on the “Receivership Documents” page of this web site. All claims against Spirit will be handled as claims against the Spirit receivership estate, and all proceedings are governed by applicable Nevada law. All claims must be submitted on the approved POC Form (available for download on the “Claims and Appeals” page of this web site). Late-filed POCs will be barred from sharing in any distribution of Spirit’s assets. In order for a POC to be considered timely filed, it must be postmarked or delivered to the Special Deputy Receiver on or before May 31, 2021. In addition to being timely filed, claims must also be non-contingent and liquidated in amount by the Claims Filing Deadline to share in any distribution of Spirit’s assets. Claims that remain contingent and unliquidated after May 31, 2021, will also be barred (subject to any exceptions found in NRS 696B.450, which will be in the Receiver’s sole discretion to determine).

Please read, and follow the instructions within, the Receivership Claims and Appeals Procedure  (available for download on the “Claims and Appeals” page of this web site) to submit your POC. Failure to complete the POC Form according to the instructions may cause your claim to be delayed or disallowed.  Please also note that although your claim may be approved in whole or in part, the receivership estate may only be able to pay a portion of your approved claim depending on the remaining assets of the estate.

The Liquidation Order directs the Receiver to liquidate and wind down the affairs of Spirit. Future notices about receivership matters, which could impact your rights, will be made through this web site. You may wish to check the site on an ongoing basis to stay informed.  You may request print copies of the POC Form and the Receivership Claims and Appeals Procedure by calling (512) 478-6000, or by writing to Cantilo and Bennett, L.L.P., Attention:  Spirit SDR, P.O.
